Court Clears eBay in Suit Over SaleEBay scored an important victory in an American court on Monday on how much vetting it is required to do of its auction listings, but the decision was in contrast to recent European court rulings. In a long-awaited decision in a four-year-old trademark lawsuit against eBay brought by the jeweler Tiffany & Company, Judge Richard J. Sullivan of the Federal District Court in Manhattan ruled that the online retailer does not have a legal responsibility to prevent its users from selling counterfeit items on its online marketplace. The verdict reaffirms that Internet companies do not have to actively filter their sites for trademarked material. Rather, they can rely on intellectual property holders to monitor their sites, as long as they promptly remove material when rights holders complain. “The court ruled that eBay does in fact meet its responsibilities regarding counterfeits,” said Rob Chesnut, senior vice president and legal counsel at eBay. “We aggressively ...

Toshiba’s Centrino 2 offering: 3 biz laptops On Monday, Toshiba celebrated the release of Centrino 2 by announcing three new business laptops built on the new platform: the Tecra M10, Tecra A10, and Satellite Pro S300. Designed for large businesses, the 14-inch Tecra M10 and 15-inch Tecra A10 incorporate Centrino 2 components and vPro technology for remote management, plus a common motherboard and image that the company claims will make service and support easier for IT departments. Both Tecra systems also offer the option of a 64GB or 128GB solid-state drive, and they incorporate Toshiba's EasyGuard technologies, which include hard drive protection, spill-resistant keyboards, fingerprint readers and Trusted Platform Modules. The small-business-oriented Satellite Pro S300 also incorporates the EasyGuard technologies--a first for the Satellite Pro line. In another first for the Satellite Pro line, the S300 has built-in support for Toshiba's express port replicator. Did we really need yet another Linux distribution? I saw over on Linux Planet that Sidux, another Debian derivative, has been born. It never ceases to amaze me at how needless some of the open-source community's development efforts are. Did we really need yet another Linux distribution? What is Sidux's claim to fame, besides an unfortunate name? ...Sidux is a great choice for Debian fans who want Debian Sid in a nice polished package, and who want it as plain vanilla as possible, rather than heavily-modified as so many Debian derivatives (such as Ubuntu) like to do. So there you have it. What? You're still here? You haven't rushed out to download it? Of course you haven't. There's no need. Yes, I could be eating my words if Sidux becomes the next OpenSUSE, Fedora, or Ubuntu, but let's face it, it almost certainly will not. IE is starting to lose market shareA new study released by Net Applications have shown that Microsoft’s Internet Explorer is starting to lose market share in favor of its two biggest competitors, Mozilla’s Firefox, and Apple’s Safari. But the Redmond based company can still take pride in the fact that about 1.1 billion people, the approximate equivalent of a 73.01 percent market share, still use IE for their internet browsing experience. Looking at last year’s statistics, the Internet Explorer browser had an approximate 79 percent market share. However, during the last few months, it has seen a steep fall down, while 6 percent of the internet browser’s users switched to other companies’ products. Mozilla’s Firefox is Internet Explorer’s main competitor. The web browser now holds 19 percent of the market, and is rapidly expanding the number of people that are using it.
